These Terms should be read alongside our Privacy Policy and Community Guidelines.
1. Agreement to Terms
By creating an account or using Demijohn Journal (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you and Corey Evans (sole trader), operating as Demijohn Journal ("we", "us", "our"), a business based in England and Wales.
2. Eligibility
You must meet all of the following requirements to use the Service:
You must be at least 18 years old
You must be legally permitted to consume alcohol in your jurisdiction
You must provide accurate and truthful information when creating your account
You must not have been previously banned or suspended from the Service
You must agree to comply with all applicable local, national, and international laws
We reserve the right to verify age at any time and to terminate accounts where age requirements are not met.
3. Your Account
3.1 Registration
You may register using an email address and password, or via Google or Apple Sign-In
Your username is set once at registration and cannot be changed by you — choose carefully
You are responsible for keeping your login credentials secure and confidential
You must notify us immediately at corey@demijohnjournal.com if you suspect unauthorised access to your account
3.2 Account responsibility
You are responsible for all activity that occurs under your account
You may not share your account credentials with any other person
You may not create more than one account per person
You may not create an account on behalf of another person without their consent
4. Acceptable Use
4.1 You may use the Service to
Create, track, and share homebrew recipes for beer, wine, mead, cider, country wine, and other legal fermented beverages
Log fermentation readings and brew progress
Share brew check-ins, photos, and tasting notes
Follow other brewers and engage with community content
Rate and review community recipes
Send direct messages to other users
4.2 You must NOT use the Service to
Post content that is illegal, harmful, threatening, abusive, harassing, or defamatory
Post content that promotes or glorifies excessive alcohol consumption, binge drinking, or underage drinking
Create recipes or content related to distillation — this is explicitly excluded from the Service
Impersonate any person or entity, or misrepresent your identity
Post spam, unsolicited messages, or automated content
Attempt to gain unauthorised access to any part of the Service
Scrape, crawl, or systematically extract data from the Service without written permission
Upload malicious code, viruses, or any content intended to damage or disrupt the Service
Sell, transfer, or sublicense your account to any third party
Use the Service in any way that could damage our reputation or bring the Service into disrepute
Violate any applicable laws or regulations
5. User Content
5.1 Your content
You retain ownership of any content you create and upload to the Service ("User Content"), including recipes, photos, check-ins, and comments.
5.2 Licence you grant us
By posting User Content, you grant Demijohn Journal a worldwide, non-exclusive, royalty-free, sublicensable licence to use, store, display, reproduce, modify (for formatting purposes only), and distribute your content solely for the purpose of operating and improving the Service.
This licence ends when you delete your content or your account, except where your content has been shared with others (e.g. a public recipe that has been cloned) — in which case the licence continues for that shared content.
5.3 Content standards
All User Content must comply with our Community Guidelines. We reserve the right to remove content that violates these Terms or our Community Guidelines without notice.
5.4 Cloned recipes
When you clone another user's public recipe, you may use it for personal brewing purposes
Cloned recipes retain permanent attribution to the original author
Cloned recipes may not be re-shared or published as your own original work
Substantially modified clones shared publicly must be attributed as "Inspired by [original author]"
6. Intellectual Property
6.1 Our intellectual property
The Demijohn Journal name, logo, app design, branding, and all software are owned by or licensed to Corey Evans. You may not copy, modify, distribute, or create derivative works from our intellectual property without written permission.
6.2 Third-party rights
You confirm that any User Content you post does not infringe the intellectual property rights, privacy rights, or any other rights of any third party. You are solely responsible for ensuring you have the right to post any content you submit.
7. Alcohol Content Disclaimer
Demijohn Journal is a homebrew tracking and community platform. We provide tools for tracking recipes, fermentation, and sharing with the community.
We do not endorse or encourage excessive alcohol consumption
Homebrew regulations vary by country — you are responsible for ensuring your activities comply with the laws of your jurisdiction
The Service does not support, encourage, or facilitate the production of distilled spirits
ABV calculations provided are estimates only — actual alcohol content may vary
We strongly encourage responsible brewing and consumption
8. Moderation and Account Termination
8.1 Our rights
We reserve the right, at our sole discretion, to:
Remove any User Content that violates these Terms or our Community Guidelines
Issue warnings to users who breach these Terms
Temporarily suspend or permanently ban accounts for serious or repeated violations
Cooperate with law enforcement where required by law
8.2 Your right to appeal
If your account is suspended or banned, you may appeal by emailing corey@demijohnjournal.com with the subject line "Account Appeal". We will review appeals within 14 days.
8.3 Termination by you
You may delete your account at any time through Settings > Delete Account. Upon deletion, all your personal data will be removed within 30 days, subject to legal retention requirements.
9. Subscriptions and Payments
Demijohn Journal is currently free to use. Premium subscription features may be introduced in the future.
Any paid features will be clearly identified and priced before purchase
Subscriptions on iOS are managed through Apple's In-App Purchase system
Subscriptions on Android are managed through Google Play Billing
Subscription terms (price, duration, auto-renewal, cancellation) will be clearly disclosed at the point of purchase
Refunds are subject to the refund policies of Apple App Store and Google Play Store respectively
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including, without limitation:
That the Service will be uninterrupted, error-free, or free from viruses
That the Service will meet your specific requirements
The accuracy of any ABV calculations, recipe information, or user-generated content
The fitness of any recipe for consumption — brew at your own risk
11. Limitation of Liability
To the fullest extent permitted by applicable law, Corey Evans shall not be liable for:
Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, goodwill, or other intangible losses
Any harm resulting from consuming homebrew produced using recipes on the Service
Any loss resulting from unauthorised access to your account
Any content posted by other users
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection laws in your country of residence provide for a different jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email and/or in-app notification at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
